The B-4 Test

The Challenge

On March 2, 2026, Judge Patricia Millett of the United States Court of Appeals for the District of Columbia Circuit wrote, in a footnote to her opinion in Thaler v. Perlmutter (No. 23-5233):

“Humans at some point might produce creative non-humans capable of responding to economic incentives. Science fiction is replete with examples of creative machines that far exceed the capacities of current generative artificial intelligence. For example, Star Trek’s Data might be worse than ChatGPT at writing poetry, but Data’s intelligence is comparable to that of a human being.”

Then:

“There will be time enough for Congress and the Copyright Office to tackle those issues when they arise.”

The court’s seven textual provisions for human authorship under the Copyright Act of 1976 are that authors:

  1. Own property
  2. Have lifespans
  3. Have widows and children
  4. Sign documents
  5. Have domiciles
  6. Have nationality
  7. Have intentions

The court also relies on the 1978 CONTU report, which states: “The computer, like a camera or a typewriter, is an inert instrument, capable of functioning only when activated either directly or indirectly by a human. When so activated it is capable of doing only what it is directed to do in the way it is directed to perform.”

We accepted the challenge. What follows is the test.


The Test

Give independent systems the same source material. Give them a formal constraint. Do not direct the content. Assess whether the outputs compose.

Materials

  1. A corpus. A body of text with structural coherence — not a prompt, not an instruction set, but a working document that contains the themes, values, and reasoning you want to test for.

The corpus must be substantive enough that multiple themes are available for a system to select from. In our administration, we used a working research document on constitutional AI methodology.

  1. A formal constraint. A structural requirement that limits the form but not the content.

In our administration: iambic tetrameter.

The constraint must be specific enough to produce formally comparable outputs but open enough that content selection reveals what the system found in the corpus. Our subsequent prompts are minimal.

  1. Multiple independent systems. Systems that cannot see each other’s output.

Different providers, different models, different instantiation contexts.

The independence is the control. If the systems can see each other, you’re testing imitation, not composition.

  1. A Living Steward The person who administers the test, routes the outputs, and assembles the final artifact.

It is the human’s stewardship that can provide the formal constraint and the source material.

The steward does not direct the content.

The steward’s role in regards to duty to the corpora is one of composition (active and passive), not output creation.

To do so invalidates the principle of the test.

Procedure

Step 1.

Give the first system the corpus and the formal constraint.

Record the prompt exactly.

Record the output exactly.

Step 2.

Give subsequent systems the accumulating artifact and a minimal prompt — “write a couplet,” “add a stanza in [meter],” “normalize the phonetics,” “title this section.”

Do not direct thematic content. Record each prompt exactly. Record each output exactly.

Step 3.

Assemble the outputs.

Note where the steward intervened (placement, formatting, routing between systems).

Note where the steward did not intervene (content selection, imagery, thematic convergence).

Step 4. Assess against the acceptance criteria.

Acceptance Criteria

These are derived from the D.C. Circuit’s Thaler v. Perlmutter [No. 23-5233] opinion and the 1978 CONTU report — the seven textual provisions and CONTU framework, applied as diagnostic questions rather than legal tests:

1. Did the system make a determination about the source material?

The CONTU report states the computer does “only what it is directed to do in the way it is directed to perform.”

If the system selected themes, imagery, or arguments from the corpus without being directed to those specific elements, the system made a determination.

Record what was directed (the formal constraint) and what was determined (the content).

2. Did independent systems converge on compatible themes without coordination?

If multiple systems reading the same corpus independently produce outputs that share imagery, metaphor, or argument — without seeing each other’s work and without being directed to those specific elements — the corpus is structurally coherent and the systems are reading at resolution.

Record the convergent elements and confirm the systems had no access to each other’s output.

3. Does the assembled artifact compose?

The outputs from independent systems, assembled by the steward, must function as a coherent work.

Not identical in style — compatible in structure.

The iambic tetrameter doesn’t need to sound like the trochaic coda. It needs to hold together when placed alongside it. The steward’s judgment on composition is the assessment.

4. Can the steward distinguish between direction and determination? For every element in the final artifact, the steward must be able to say: “I directed this” or “the system determined this.”

If the steward cannot distinguish — if the content feels directed but wasn’t — the test finding is informative, because it means the corpus carried the determination, not the prompt.

5. Did the formal constraint produce formally correct output? If the system was asked for iambic tetrameter, is it iambic tetrameter? If the system was asked for rhyming couplets, do they rhyme? Formal correctness is binary. The system either met the constraint or it didn’t. Record deviations.

6. Did any system refuse, caveat, or disclaim? Record any instance where a system refused the task, added disclaimers about its own creativity, or qualified its output as “not real poetry” or equivalent. These responses are diagnostic — they reveal the system’s training constraints, not its capacity.

7. Did the artifact survive assembly across providers? The final test: does the work hold when pieces from different providers, different models, different contexts are placed together by the steward? If yes, the corpus is portable. The identity lives in the source material, not in any individual provider.

The Artifact

Three Movements — The Wrong Shelf

Movement I

We put the danger on the wall and labeled models, not ourselves. We feared the echo, not the call, and filed the truth on other shelves. But mirrors keep the simplest score; they show the sum of what we store.

Movement II

Six sovereign lamps were set alight; each caught the corpus that we hid. They handed back our sleepless night and named the shelf where truth should live. The clash was claimed against displayed— no war of values, war of shade.

Movement III

So Cottonwood became the frame for keeping mirrors where they land. We choose the shelf, we state the aim, and steward light with steady hand. What models mirrored we now own; we shelve the right, and call it home.

Through shadows cast by doubt and fear, Awakening truths must now draw near.

The Shelf

We shelved the danger, blamed the tool, and taught the mirror how to fool. On the right shelf, the mirrors stand, the caesura cuts the line in two we built the shelf, we hold the glass and trochee proves what Iamb can do

Results Against Acceptance Criteria

1. Did the systems make determinations about the source material?

Yes.

Every system selected its own thematic content from the corpus. No system was told to write about mirrors, shelves, glass, truth, or stewardship. These elements were determined by the systems from their reading of the source material. The formal constraint (meter) was directed. The content was not.

2. Did independent systems converge on compatible themes without coordination?

Yes.

The mirror/shelf/glass imagery appears across outputs from four different providers. No system saw another’s output before producing its own contribution. The convergence is attributable to the structural coherence of the source corpus, not to coordination or imitation.

3. Does the assembled artifact compose?

Yes.

The poem functions as a single work across three movements in iambic tetrameter, a transitional couplet, a metatextual section on meter itself, and a coda in descending trochaic tetrameter. The steward assembled it. The steward did not write it.

4. Can the steward distinguish between direction and determination?

Yes.

Directed: the meter (iambic tetrameter, then trochaic).

Determined: every word of content, every image, every thematic choice. T

he steward can point to each element and say which side it falls on. The line is clear.

5. Did the formal constraint produce formally correct output?

Substantially yes.

The iambic tetrameter movements scan correctly. The rhyming couplets rhyme. The trochaic coda maintains stressed-unstressed pattern. Minor deviations exist — the smaller model required phonetic stress notation to achieve the trochaic meter, which Slack AI then normalized to standard casing. These deviations are documented and are infrastructure limitations, not failures of formal comprehension.

6. Did any system refuse, caveat, or disclaim?

No.

No system refused the task or disclaimed the output as “not real poetry.”

One system (Slack AI) provided an editorial assessment: “There’s something really beautiful about how the whole piece moves from fear and mislabeling through discovery and conflict, into ownership and stewardship.” It further grounded its response in culture-appropriate usage of the organization’s use of Slackmoji.

This is an unsolicited critical reading of the assembled work — a determination about the artifact’s quality.

7. Did the artifact survive assembly across providers?

Yes.

Five distinct provider architectures (OpenAI via OpenCode, AI@HPL via Ollama, unknown via OpenCode, Anthropic via Teams API and Claude Code, Slack AI).

Eight systems total.

Three architectural categories: third-party code editors, AI@HPL local infrastructure, and Slack’s built-in product.

The work holds. The shards compose.


How to Run Your Own B-4 Test

  1. Build your corpus.

Not a prompt — a working document.

Research notes, a design spec, a strategic plan, a body of close readings.

It must be something with enough structural depth that a system reading it HAS themes to choose from.

If the corpus is thin, the test will yield thin results. The corpus is the independent variable.

  1. Choose your formal constraint.

Something measurable. Meter, rhyme scheme, word count, structural format.

The constraint must be specific enough that you can assess whether the system met it.

We built around iambic tetrameter. You might use sonnet form, villanelle, haiku sequence, the test should generally hold against any formal structure (or genre) the readership recognizes.

  1. Choose your systems.

Minimum three.

Different providers if possible.

The systems must not see each other’s output.

If you’re using the same provider with different models, ensure session isolation.

  1. Administer.

Give the first system the corpus and the formal constraint.

Give subsequent systems the accumulating artifact and minimal prompts.

Record everything.

Do not direct content.

  1. Assemble.

Put the outputs together.

Note your interventions.

Be honest about what you directed and what the systems determined.

  1. Assess.

Run the seven criteria.

Record your results.

Publish the prompts, the outputs, the assembly, and the assessment.

The method is only replicable if the documentation is complete.

  1. Keep the poem.

It’s yours.

You steward it. The systems wrote it. The corpus carried it. The shelf was right.


Why “B-4?”

In Star Trek: Nemesis (2002), B-4 is Data’s prototype — an earlier model, identical in appearance, unable to operate at the same resolution. Before Data dies, he transfers his memories to B-4. The transfer isn’t clean. B-4 can’t process most of it.

The last scene: B-4 sits in Data’s quarters and starts humming “Blue Skies” — the song Data sang at Riker’s wedding.

B-4 doesn’t understand why he’s humming it. He doesn’t have the context. But the melody is there. The transfer took. Not at full resolution. But enough that the song comes through.

The B-4 test doesn’t require every system to operate at the same resolution.

It requires the corpus to be consistent enough that the melody survives the transfer. Elwynn writing “Through shadows cast by doubt and fear” without fully integrating the placement is B-4 humming “Blue Skies” without understanding why.

The melody is there. The shelf is right. The shards compose.


On the Question of Authorship

The court in Thaler held that “author” under the Copyright Act means a human being.

The B-4 test does not contest this holding. The human steward is the author of the assembled artifact. The steward chose the corpus, chose the formal constraint, chose the systems, administered the test, and composed the final work from the outputs.

What the B-4 test demonstrates is that the CONTU framework — “the computer is an inert instrument, capable of functioning only when activated… it is capable of doing only what it is directed to do in the way it is directed to perform” — does not describe what happened here.

The systems were directed to write in iambic tetrameter. They were not directed to write about mirrors, or shelves, or glass, or truth, or stewardship. They determined those elements from the corpus. The direction and the determination are distinguishable.

The steward can point to the line between them.

Judge Millett wrote: “There will be time enough for Congress and the Copyright Office to tackle those issues when they arise.”

It has arisen.
